A Le Mars man on trial for stabbing another local man in a fight got a light conviction Wednesday in court.
Christopher Velarde, 24, was found guilty of simple assault by a jury.
That's a much lighter conviction than he originally faced.
He originally faced a felony charge -- willful injury -- and another aggravated misdemeanor -- aggravated assault, which could have landed him in prison for up to seven years total.
The simple assault charge is a simple misdemeanor.
Velarde was arrested on April 28 after a fight that broke out at 2 a.m. on a sidewalk on Central Avenue near Dinger's Bar and Keith Langel CPA.
Two people, Joshua Thompson, 26, and Melody Ropte, 30, of Le Mars received non-life-threatening stab wounds or knife cuts, according to the original report from the Le Mars Police Department.
Thompson had a 1-inch stab in is abdomen and a cut on his neck, and Ropte received a cut on her hand. Both were treated that night at Floyd Valley Hospital and released.
After the fight, Velarde tried to run away from the scene of the crime on foot, but witnesses chased him down, according to the police.
Witness and police testimony in court stated that Velarde was finally captured six blocks away from the original fight scene. He was hiding in a basement of a house on Second Avenue Northwest, across from the KLEM radio station.
A bloody pocketknife was found in the washing machine in that same basement.
Velarde was booked into the Plymouth County Jail.
No charges were filed against Thompson or Ropte.
No fingerprints or blood samples were taken to link the knife or blood to anyone involved that night.
None of the witnesses recall actually seeing the knife in Velarde's hand.
Velarde's trial began Tuesday and continued Wednesday.
The jury heard closing arguments Wednesday and spent more than four hours deliberating before making their decision.
For the jury to give Velarde the full conviction of the willful injury felony, the state prosecutor would have to prove that Velarde not only assaulted Josh Thompson, but also that Velarde intended to cause serious injury to Thompson and that Thompson sustained a bodily injury.
For the jury to give Velarde the full conviction on the aggravated assault charge, the state would have to prove that Velarde committed an assault on Ropte and that he used or displayed a knife.
The jury decided that there was not enough proof to give these full convictions.
They did agree that the state proved Velarde assaulted Thompson, resulting in the simple assault charge.
After hearing the jury's verdict late Wednesday afternoon, Judge Jeff Neary sentenced Velarde to 30 days in prison, giving the defendant credit for time he already spent in jail.
He would have been free to go, but he still faces two unresolved charges:
*interference with official acts, a simple misdemeanor, stemming from the night of the stabbing.
*assault causing bodily injury, a serious misdemeanor. This assault charge stems from an incident at the Plymouth County Jail where Velarde allegedly assaulted another inmate causing bodily injury on July 22, 2008.

Wow he got off on assaulting 2 people at a bar after assaulting an inmate in jail.... nice. It seems he has some anger issues he could use to work on in his jail cell.
I guess I am not sure what everyone wants here, he was arrested,charged, he went to trial, the JURY is the one who found him guilty of the lower charges. How is that the towns fault?? Arent you the one VDSHarley that doesnt even live in this town anymore??Didnt you leave 24 years ago? Pretty easy to "judge" for afar I guess. Give me a break............
These results are from an incompetent investigation. If there were more facts to link him to the crime and a real attempt to verify claims instead of hearsay, (blood samples, etc) then it may have been a tougher case for him. I wasn't there and maybe the stab wounds were more of a scare than anything. But they are a warning sign. Anger management might be a good thing for this individual. Maybe he'll get a gun next time?
Once again the court system has failed, and a habitual violator has been allowed to go free. I am thankful that the man assulted recovered from his injuries and was able to get on with his life. I pray that the next time this man chooses to stick a knife into someones belly, the result will not be more serious or fatal before justice is acomplished. I take comfort in knowing this person will one day meet his highest supreme judge, and then there will be justice.
Why do you throw stones at someone when we have all made mistakes? I know people that were at the bar the night of this happening. And i want to make 2 things VERY clear. This kid did not stab out of anger this kid was protecting himself. From what the police report states to what really happen is the reason he got a leasor charge. But you people don't look at it that way. I understand stabbing someone is the last thing you should do. I'm not condoning that. But from what I heard from MANY people that this kid was harrassed all night and was followed out of the bar by the guy and was thrown to the ground.
Second thing I heard is the lady didn't even get cut by a knife. From what I understand a watch cut her hand as she was trying to break up the fight. And also she told police that and they said no mam you got cut from a knife. LOL I guess she was to drunk to know what happen to her hand.. WOW.
So we all judge this kid on what we heard right? Well I heard a different story from people that were there. This kid is an outsider and in the Le Mars bar if your an outsider your an imediate target which is wrong in the first place.
I'm not saying what this kid was right but I know if you were in a similar situation you would react the same way. And anyone that says they wouldn't is lying to themselve.
Why don't we dig and find the real problem DRINKING. How many good things have come from getting loaded? So far this year we had a guy hit a pedestian while he was drinking and driving. And we had a bar fight with a knife involved, we have had someone killed in apartments from getting drunk coming home and stabbing him to death. Then we have countless DUI arrest. And nobody wants to face the real problem. That drinking affects not only your decision making but it makes you do things you normally wouldn't do.
But I gues we will continue to avoid this subject....
